Clean Slate Policy Information
What are clean slate policies?
Clean Slate record sealing policies allow individuals to have certain criminal records sealed. These policies offer people who have completed their sentences and remained crime free for a period of time the chance remove barriers created by having a record.
Clean Slate policies involve automated or streamlined processes for identifying eligible cases and sealing the corresponding records. The specific criteria and procedures may vary depending on the jurisdiction and the nature of the conviction or arrest record.
Clean Slate record sealing policies primarily aim to tackle the enduring repercussions of a criminal record, which often impede individuals from obtaining employment, finding suitable housing, accessing educational opportunities, and rebuilding their lives. Through record sealing, people are offered a fresh start and face fewer barriers to opportunity due to their past.
Clean Slate in Kentucky
Kentuckians stand together to support their neighbors and local businesses, fostering an environment of prosperity. Individuals from diverse backgrounds and affiliations are rallying behind the Kentucky Clean Slate proposal, recognizing that when individuals are empowered to support themselves and their children, the entire community benefits.
The Clean Slate Act (HB 569/SB218) in Kentucky could increase public safety and bring economic benefits.
- The clearance of public criminal records reduces recidivism.
- Within 2 years of receiving an expungement, a person’s likelihood of being employed increases significantly, and their personal income increases 25%. (J.J. PRESCOTT & SONJA B. STARR 2019)
- Employment is one of Kentucky’s best defenses against recidivism. Growing the workforce is critical for the tax base and the economy.
- Petitions aren’t enough. Without an automatic process only 6.5% of the people eligible, according to a recent study, take advantage of the expungement process. Making the process automatic would help the other 93.5% of eligible people realize the benefits of record sealing.
It is estimated that around 500,000 Kentuckians, approximately 11% of our state’s population, are eligible for expungement of their records. This staggering number represents a substantial portion of our population who deserve a chance at redemption.
By supporting Clean Slate legislation, we create a safer community while demonstrating our commitment to a system that recognizes the value of rehabilitation and reintegration. We provide hope for those seeking to break free from the cycle of incarceration and contribute positively to the future of our state.
